
In a recent court decision highlighted by the local authorities, Brittney Mortimer was convicted on multiple drug-related charges, including the distribution of fentanyl that led to death. The sentencing followed a jury finding Mortimer guilty of various felonies, ranging from the distribution of a controlled substance causing death to the distribution of methamphetamine.
The conviction stems from a February welfare check by the Fort Collins Police Services, who discovered Edward Dzienowski, deceased from a fentanyl overdose in his apartment, according to Larimer County. The ensuing investigation pointed to Mortimer, who had allegedly sold Dzienowski drugs on four different occasions. Found between the suspect and the victim were text messages that established the sales transactions beginning in mid-February.
An additional co-defendant's case in connection with this matter is still open, and they maintain their presumption of innocence until proven guilty. As for Mortimer, the possible sentences include 12-32 years in the Department of Corrections and fines that could reach up to $1 million for the class one drug felony. Lesser sentences accompany the other class three drug felonies.
District Attorney Gordon McLaughlin lauded his team's efforts and their relentless dedication, adding that “This case represents our fifth successful conviction for Fentanyl Resulting in Death prosecution in the 8th Judicial District—one of the highest numbers in the State of Colorado,” as obtained by Larimer County. Mortimer's sentencing is scheduled on January 5th. McLaughlin stressed the ongoing commitment to justice for victims of the fentanyl crisis and holding accountable those responsible for such community losses.
