
Illinois Attorney General Kwame Raoul, flanked by a broad coalition of 25 counterparts from across the United States and New York City, has firmly positioned himself against Shopify Inc., in their stance on the sale of electronic cigarettes through its service. The group penned a letter to the e-commerce platform, spotlighting the ongoing issue of illegal e-cigarette sales online, a letter which Illinois Attorney General’s office made public.
In their communiqué, the attorneys general underscored that despite Shopify's policies restricting unlawful activities on their platform, an alarming number of retailers continue to exploit the service to distribute unlawful e-cigarettes, including 29 specific websites currently supported by Shopify, and more than 200 discovered to be selling illegal tobacco products. "E-cigarettes, which are highly addictive and pose significant health risks, have flooded the market nationwide and must be subject to strict regulation," Raoul was quoted, pointing to the vulnerability of youth to this high-risk product and affirming his commitment to attack the issue head-on.
Last April, Shopify responded by terminating some vendors upon notification, demonstrating enforcement efforts on its terms, prohibiting illegal activities. According to the coalition's proposal, a partnership between Shopify and state officials would share the burden of rooting out the rogue sellers, where the state attorneys general would aid in pinpointing unlawful merchants to notify Shopify.
Regulatory oversight is a key theme in this multi-pronged approach against unapproved tobacco sales. Under federal law, all new tobacco products require a green light from the FDA – yet only 39 e-cigarette products, sans any flavor aside from tobacco and menthol, have received authorization. This stipulation turns the cross-border receipt or delivery of any unauthorized tobacco item into a federal offense. Attorney General Raoul has also taken direct action on this front with a January lawsuit against distributors of a popular vape brand under the Preventing Youth Vaping Act – a significant move in curbing the flow of these products into Illinois.
The alliance joining Raoul spans states from coast to coast, including, but not limited to, Arizona, California, and Connecticut – extending even to the District of Columbia and the Commonwealth of Puerto Rico. Their concerted push aims to advocate for public health and uphold the rule of law in the rapidly evolving digital market, where e-cigarettes and vaping products pose continually emerging challenges.
