The statement also said that the NYPD did not act on a prior detainer that would have transferred Tall into federal custody, which DHS said could have prevented further alleged illegal activity.

Federal authorities stated that additional incidents might have been avoided if Tall had been transferred to ICE following his arrest in October. DHS reported that Tall was released after the initial arrest and was subsequently arrested again on October 11 for felony trademark counterfeiting. The NYPD said they were carrying out routine vendor enforcement when ICE agents arrived and did not interact with the federal agents on site.
