
Texas Attorney General Ken Paxton has taken legal strides to prevent Kenvue, the manufacturer of Tylenol, from issuing its upcoming November 26 dividend. Paxton's office filed a motion citing concerns that the dividend payment could deplete Kenvue's funds, funds which may be required to compensate Texans for Kenvue's alleged deceptive marketing practices and other legal liabilities. The controversy centers on claims that the company marketed Tylenol to pregnant mothers without adequately disclosing risks associated with the drug's active ingredient, acetaminophen, specifically the increased chances of autism and ADHD in children.
Just week ago, Paxton sued Kenvue and parent company Johnson & Johnson, aiming to hold them accountable not only for the marketing issue but also for a corporate spinoff allegedly designed to skirt financial responsibilities. "I will not allow Big Pharma to ruin the lives of Texans with their lies and then refuse to pay the bill when it's brought to account," Paxton stated. According to the Texas Attorney General, this move by Kenvue could potentially render the company insolvent, undermining its ability to fulfill future civil penalties.
The motion put forth by the attorney general's office seeks to prevent Kenvue from proceeding with any dividend payments or extraordinary asset dispositions until a final judgment in the case is reached. Paxton's actions reflect a broader endeavor to ensure that companies are held financially liable when their actions violate laws and potentially harm consumers. The legal battles facing Kenvue, as per the claims made in Paxton's lawsuit, could amount to a financial exposure in the billions.
In addition to halting dividend payments, Paxton is seeking an injunction to put an end to Kenvue's allegedly illegal marketing strategies. Should courts honor this motion, it would solidify a necessary financial pool from which Texas could extract penalties if Kenvue is found liable.
