
Harris County deputies say a routine traffic stop on the Eastex Freeway turned physical last Saturday when they pulled over a driver they allege was drunk and carrying a loaded gun. According to deputies, the stop on the 11400 block of the Eastex ended with the driver, identified as Hzuimireas Lee, in handcuffs and on his way to the Harris County Jail after a brief struggle. Officials say he was found intoxicated, armed, and less than cooperative when they tried to detain him.
In a post on Constable Mark Herman, precinct officials say deputies conducted standardized field sobriety tests at the scene and determined Lee was intoxicated. A breath test later registered a 0.145 alcohol concentration, according to the post, which also states deputies discovered a loaded firearm inside the vehicle.
Deputies say Lee physically resisted during the attempted detention, and the scuffle did not end at the roadside. The constable’s post alleges that while Lee was being booked into the Harris County Jail, he assaulted a Harris County detention officer. Bond was set at $15,200, according to the same post.
Charges And Court Filings
Harris County court records list filings dated Dec. 13 charging “LEE, HZUIMIREAS SJEFTCAH” with Driving While Intoxicated and Unlawful Carrying of a Weapon in County Court 6 and the 482nd District Court, according to the Harris County District Clerk. The entries reflect the initial charging instruments and are available on the clerk’s public new filings list.
What Texas Law Says
Under Texas law, driving with a blood or breath alcohol concentration of 0.08 or higher can lead to a DWI charge, and a reading of 0.15 or above can mean enhanced penalties under the Penal Code. See Texas Penal Code §49.04.
Separately, the state’s unlawful carrying statute regulates firearms in motor vehicles and includes provisions that make carrying a firearm while intoxicated a criminal offense. See Texas Penal Code §46.02. Assaulting a public servant or peace officer can bump an assault allegation up to a felony under state law. See Texas Penal Code §22.01.
What Happens Next
The constable’s post states that Lee was booked into the Harris County Jail on a total bond of $15,200, and county records confirm that the DWI and unlawful weapon charges are now on the docket in County Court 6 and the 482nd District Court. Any future hearings, new filings, or additional counts will appear in the court records as the case moves forward. All of the allegations remain accusations only unless and until they are proven in court.
