The two-day trial was replete with testimony about Fogle's actions leading up to the incident, including his ejection from the establishment for inappropriate behavior with one of the dancers. The state prosecutors presented evidence of multiple phone calls and text messages from Fogle that night, wherein one text message he bluntly stated, "Goodbye, I'm going to prison for vehicular manslaughter," as FOX 13 News reported.

Maria Dunker, Fogle's public defender, contended throughout the trial that her client's intoxicated state called into question his capacity to form a premeditated intent to kill. "Is he making any sense at all, or are we trying to make sense of a drunk, senseless man," Dunker urged the jury to consider, according to coverage by both WFLA and FOX 13 News. Her implication, that Fogle had not set out to to deliberately harm anyone, was ultimately unpersuasive to the jury. A further hearing has been scheduled for the end of December to address the remaining counts, which may lead to additional consequences for Fogle.
