Events escalated when the suspect, identified as Edgar Lumbi Cacuango, exited his vehicle to urinate on the road following which the officers arrived on the scene at approximately 9:10 p.m. and observed his gray Ford Edge stalled across the center lines, this quick succession of dangerous actions culminated in his vehicle accelerating and colliding with the police cruiser. When the Milford officers approached the Ford Edge to apprehend Cacuango, they found several empty Modelo beer cans inside and noted a strong odor of alcohol, as reported by the Milford Police Department.

Lumbi Cacuango was subsequently arrested on suspicion of OUI after being observed claiming the passenger seat post-collision. In a statement made by Milford Police Chief Robert Tusino, it was emphasized that "Our officers place themselves in harm’s way every day to keep our community safe," and he condemned the demonstrated "negligence and zero care for our first responders or others on the roadway," as mentioned in the same social media post.  Following the incident, the suspect underwent a voluntary breath test at the Milford Police Department, which indicated his blood-alcohol content as more than twice the legal limit.
