Prosecutors have presented evidence of alleged reckless behavior, including social media videos showing him driving at speeds of up to 125 mph before the collision.

In a statement obtained by the Suffolk County DA’s Office, District Attorney Tierney offered condolences to her family and affirmed a commitment to justice. Espinosa was a wife, mother, and law enforcement officer. At Matthew Smith’s court appearance, fellow officers and her husband, who is also a Nassau County police officer, were present.
In court, 20-year-old Matthew Smith, who is under the legal drinking age, faced evidence regarding his blood alcohol level, reported at 0.20—nearly three times the legal limit. Prosecutors noted that Smith’s parents, who were present in the courtroom, had previously dealt with his dangerous behavior, including an arrest for assaulting his father. He also had a history of speeding violations, with prosecutors describing him as using public roads recklessly.
