A weekend afternoon in Clarendon took an unsettling turn when a 41-year-old man was arrested after police say he exposed himself outside a business, then assaulted someone on the sidewalk minutes later. Officers responded shortly after 3 p.m. to the 1100 block of North Highland Street in Arlington and found the suspect still at the scene. No serious injuries were reported. The man, who police say has no fixed address, was taken into custody and held without bond.
Police account
According to the Arlington County Police Department, as reported by Daily Voice Elkton, officers say the suspect, identified as Donte Smith, allegedly exposed himself outside a business before assaulting a person on the sidewalk. Smith was charged with indecent exposure, listed as a third-or-subsequent offense within 10 years, along with assault and battery and public intoxication. The report notes that officers took him into custody without further incident and that no serious injuries were reported.
Charges and penalties
Indecent exposure is defined in Virginia law and carries stiffer penalties when a defendant has prior qualifying convictions. As outlined in Virginia Code § 18.2-387 and the related repeat-offense provision, a third-or-subsequent indecent-exposure offense within a 10-year period may be treated as a Class 6 felony under state law. That designation requires allegations and proof of prior convictions and can carry a sentence of up to five years in prison upon conviction.
What neighbors should know
The incident unfolded in a busy Clarendon commercial stretch during daylight hours, a reminder that these types of offenses can occur in well-trafficked neighborhood hubs. Arlington police are encouraging anyone with footage or information related to the case to share it with investigators to help support the prosecution. Victims and witnesses who want support are urged to contact county victim-services resources for guidance and assistance as the case moves forward.
