
In a tense Miami-Dade courtroom Tuesday, 43-year-old inmate Marcus Terry actually giggled as a judge described how his cellmate was killed and then told him he would die behind bars. At one point, Terry looked at the bench and told the judge, "You are amusing," a moment that drew a sharp verbal smackdown before the hearing pushed ahead.
Judge's account
Terry was convicted in December 2025 of second-degree murder. At sentencing, Miami-Dade Circuit Judge Ellen Sue Venzer rejected a defense request for a new trial and reminded Terry that jurors had heard evidence that he jammed a pen into his cellmate's brain, shoved a pillowcase into the man's mouth and was found standing over him with a bloodied hand. "I'm not sure why you're laughing," Venzer told him, later adding, "God have mercy on your soul," as she imposed life in prison without the possibility of parole, according to NBC 6 South Florida.
How the killing unfolded
The deadly attack unfolded inside the Miami-Dade jail system in April 2021, when a correctional officer found Terry's cellmate bleeding from the head. Authorities later said the weapon used was a pen. Early coverage and court filings indicated Terry was accused of stabbing his cellmate and was transferred after the killing, and that the victim had been serving a life term, per WPLG Local 10.
Legal next steps
Defense attorney Steven Yermish had asked Venzer for a new trial, arguing that jurors were exposed to evidence that should have been kept out. She denied the motion and moved straight into sentencing.
