
An off-duty Atlanta police officer’s early-morning security shift in Midtown turned violent Friday when a car jumped a median and slammed head-on into his marked patrol vehicle, which was set up to protect a construction lane closure. The collision happened around 5:17 a.m., and emergency crews treated the officer at the scene before taking him to Emory Midtown Hospital with reported neck injuries.
According to the Atlanta Police Department, the other driver left his lane, crossed the median and hit the front of the cruiser. Officers at the scene said they noticed signs of impairment and identified the driver as 34-year-old Desmond Brown. He agreed to field sobriety tests and later provided a breath sample that registered .208, after which he was arrested and charged with DUI Per Se, DUI Less Safe, reckless driving and failure to maintain lane. His vehicle was towed, and he was transported to Grady Detention for medical clearance before being transferred to the Atlanta City Jail.

As reported by FOX 5 Atlanta, the off-duty officer was working an extra security detail at the intersection of Juniper Street NE and 6th Street NE, sitting in a marked patrol car with emergency lights activated for a construction-related lane closure when Brown’s vehicle crashed into the cruiser. The outlet noted the officer was awake and breathing after the impact. Police have not released the officer’s name or any further update on his condition.
Charges and legal context
Brown now faces both a DUI Per Se charge and a DUI Less Safe charge, a combination that is often used when officers report visible impairment alongside a chemical test result. Under O.C.G.A. § 40-6-391, as outlined in the Georgia Code, a blood-alcohol concentration of 0.08 or higher supports a DUI Per Se count. Convictions under the statute can lead to fines, jail time and administrative penalties affecting a driver’s license, depending on the circumstances of the case.

The Atlanta Police Department says the investigation into the crash remains active and that Brown will be formally processed into the Atlanta City Jail once he is medically cleared by Grady.
