Cobb County authorities say a routine trip to the pool turned into a criminal case when a Marietta man was arrested last Friday, accused of secretly recording someone as they stepped out of a shower at the Mountain View Aquatic Center. Investigators allege Jason Livernois hid his phone in a bag, angled the camera toward a shower stall, and captured video as the person pulled back the curtain and walked out nude. He has been charged with eavesdropping-surveillance and is currently being held without bond.
An arrest warrant obtained by Channel 2 Action News states the phone was actively recording when the victim exited the shower and that Livernois had positioned it inside his bag with the camera trained on the stall, according to WSB‑TV. WSB‑TV reports Livernois was arrested on May 29 and, citing county jail records, remains in custody with no bond set.
Where the incident took place
The alleged recording happened at the Mountain View Aquatic Center in East Cobb, a county-operated indoor complex that draws locals for lap swim, lessons, and family swim sessions. The facility’s information page on Cobb County Parks lists schedules, programs, and upcoming swim meets, but it does not mention Livernois’ arrest or note any changes to locker room or shower security.
State law and penalties
Georgia law makes it illegal to use any device to “observe, photograph, or record the activities of another which occur in any private place and out of public view” without that person’s consent, according to Georgia Code §16‑11‑62. Violating this statute is a felony that can carry one to five years in prison or fines up to $10,000, under the penalty provisions in Georgia Code §16‑11‑69.
What happens next
Any move to add or modify charges, along with the timing of Livernois’ next court appearance, will show up in formal court filings and the Cobb County jail roster. For now, the public record on the case hinges on the arrest warrant and booking information reported by WSB‑TV.
