A Waldorf man has admitted to sexually abusing and raping a 13-year-old girl in what prosecutors say was a late-night attack inside the family’s garage earlier this year.
On June 12, 27-year-old Elmer Geovanny Marquez-Orellana pleaded guilty in Charles County Circuit Court to sex abuse of a minor and second-degree rape. The assault occurred in mid-January, according to court filings. Under a plea agreement, he will be required to register for life as a Tier 3 sex offender, the state’s most serious classification. Sentencing is scheduled for August 27, 2026.
Prosecutors’ Account and Evidence
Officers with the Charles County Sheriff’s Office were called to a Waldorf home on January 19 after the girl and her parents reported the assault. Investigators said Marquez-Orellana had visited the family on January 18 and stayed overnight.
According to prosecutors, in-home surveillance footage showed Marquez-Orellana entering the garage shortly before the girl walked in. The victim’s mother later saw both of them unclothed in the garage, authorities said. A sexual assault nurse examination was performed, and forensic testing identified DNA consistent with Marquez-Orellana, as reported by The Southern Maryland Chronicle.
Indictment and Court Filings
A grand jury indictment filed on February 13, 2026, under case number C-08-CR-26-000104, charged Marquez-Orellana with multiple counts, including Sex Abuse of a Minor and several counts of second-degree rape. The filing outlines the full slate of original charges brought before the plea.
The Maryland Courts’ Cases Filed Report lists the indictment and defendant information, including the charges and filing date, in the public record (Maryland Courts).
Legal Consequences and Registration
Under Maryland law, second-degree rape is a felony punishable by up to 20 years in prison. Sexual abuse of a minor is a separate felony that can carry decades of potential exposure, depending on the number of counts and any aggravating factors.
The plea requires Marquez-Orellana to register as a Tier 3 sex offender, the state’s highest classification, which involves frequent in-person verification and can include public notification. The relevant criminal statutes and registration rules are set out in the Maryland Code, including Md. Code, Crim. Law § 3-304 (Maryland General Assembly) and § 3-602 (Maryland General Assembly), and the registration requirements in CP § 11-707 (FindLaw).
