According to a July 29 post from Polk County Sheriff Grady Judd, a deputy stopped a gray Honda HR-V Tuesday afternoon in Lakeland, where 68-year-old Cynthia Lee Green was riding as a passenger. Deputies said Green appeared nervous and tried to conceal a large bulge in her pocket before removing two plastic bags containing 55.90 grams of fentanyl and 2.14 grams of cocaine. Green was booked on charges of trafficking in fentanyl, possession of cocaine and possession of drug paraphernalia, while 63-year-old Marc Kidwell of North Port was booked on the suspended-license charge.
Why The Fentanyl Charge Is Serious
Florida law allows prosecutors to charge someone with fentanyl trafficking when the alleged possession involves 4 grams or more, according to the Florida Senate’s official statute page. For 28 grams or more, the law sets a first-degree felony, a mandatory minimum sentence of 25 years and a $500,000 fine if there is a conviction, putting the alleged amount in this case well above that threshold.
Arrests Are Not Convictions
Green and Kidwell were taken to the Polk County Sheriff’s processing center and booked, according to the sheriff’s post. The Polk County Sheriff’s Office jail inquiry cautions that an arrest does not establish guilt and that case outcomes must be obtained from the courts.
