Earlier in the summer, two men were stabbed in the back during an early-morning fight on Eighth Avenue near West 46th Street on July 23, prompting an overnight police sweep through Midtown's theater district. And in April, an 18-year-old suffered multiple stab wounds to his abdomen, back, and hip near West 39th Street and Eighth Avenue before being rushed to Bellevue Hospital.

Midtown's 24-hour fast-food spots have drawn particular attention amid the recent violence. Local video circulating this month showed a chaotic brawl among teenagers inside a McDonald's at 1651 Broadway, reigniting community debate over youth disruption and private security staffing at fast-food franchises in the neighborhood.
The concern is not new. As far back as November 2015, a fatal shooting and double wounding took place outside a 34th Street McDonald's near Penn Station following a dispute tied to local drug turf, according to NYPD reports at the time — a reminder that Midtown's all-night fast-food counters have long drawn scrutiny as flashpoints for violence.
Legal Stakes for Whoever Is Found Responsible
Under New York Penal Law § 120.05, intentionally injuring someone with a knife or other dangerous instrument is classified as second-degree assault, a Class D violent felony punishable by up to seven years in state prison. If investigators determine that three or more people acted together in the attack, prosecutors could pursue gang assault charges under Penal Law §§ 120.06 and 120.07 — Class C or Class B violent felonies carrying maximum sentences of 15 to 25 years, regardless of any formal gang affiliation.
