Bronx Man Indicted on 10 Felony Counts in Greenburgh Mother-Daughter Attack

A Bronx man accused of forcing his way into a Greenburgh home and attacking a mother and daughter has been indicted on 10 felony counts, including burglary as a sexually motivated felony and attempted rape. Alberto Botero, 39, was arraigned in Westchester County Court on Tuesday, entering a not guilty plea before he was remanded to the Westchester County Jail without bail.

According to News 12 Bronx, Botero attacked a mother and daughter inside their Westchester County home, with authorities saying he attempted to rape the woman's daughter before officers took him into custody at the scene. Prosecutors have since laid out a far more detailed account of what happened, and it began, according to Westchester County District Attorney Susan Cacace's office, on Wednesday, July 1, at roughly 6:25 p.m., when the daughter went to the front door to retrieve a delivery, as detailed by Tarrytown Patch.

A Chase Up the Stairs

Court filings described by the Hudson Valley Post say Botero forced his way into the house as the daughter tried to close the front door, then chased her upstairs, grabbed her by the neck, shoved her onto a sofa and forcibly attempted to pull up her dress while removing his own pants. The account marks a shift from initial reports, which indicated the mother believed Botero was a delivery driver before the confrontation escalated.

The mother intervened by striking Botero with a broom, according to the same reporting. Botero then allegedly shoved her to the floor, dragged her by her hair, pinned her down and squeezed her neck, per the same account. Both the mother and daughter received medical treatment at the scene.

Daughter's Escape Brought Police to the Scene

The daughter threw objects at Botero to stop the assault on her mother, then ran outside to call for help, the article notes. Greenburgh Police officers responding to the call arrested Botero immediately outside the residence as he chased her out of the home.

Formal Charges and What Comes Next

The grand jury's indictment, announced Tuesday by Cacace, formally charges Botero with first-degree burglary, burglary as a sexually motivated felony, attempted rape and felony assault among the 10 counts, according to Mid Hudson News. Senior Assistant District Attorney Mollie O'Rourke of the Westchester County District Attorney's Sex Crimes and Human Trafficking Bureau is handling the prosecution.

The burglary as a sexually motivated felony charge carries a specific legal standard under New York Penal Law § 130.91, which requires prosecutors to prove both the underlying burglary and that the crime was committed in whole or substantial part for direct sexual gratification, a threshold the New York Court of Appeals clarified in its 2024 decision in People v. Seignious. Botero is due back in Westchester County Court on November 24 for his next scheduled appearance while he remains held without bail.

The alleged attack stands out against the county's broader crime trends. Westchester County Government data released in May showed overall index crime fell 17 percent in 2025 compared to the prior year, with violent crime dropping 25 percent, according to county officials who highlighted the declines during the 2026 State of the County address.

Greenburgh, where the attack took place, sits in southwestern Westchester County between the Hudson and Bronx rivers and is the 12th largest town by population in New York State, with roughly 95,000 residents spread across 31 square miles and six incorporated villages, per Wikipedia.
