A former substitute teacher who spent just three days at Lennard High School before he was arrested has been sentenced to 10 years in prison for sexually assaulting a student he met on campus. Joseph Prevatte entered an open plea in Hillsborough County court, admitting to conduct that included kissing and sexually assaulting the teenage victim after arranging to meet her in his classroom before school.
According to FOX 13 News, Prevatte worked as a substitute at Lennard High School in October 2024 and sent the student sexually explicit messages, according to court filings cited in the outlet's report. Detectives said Prevatte arranged to meet the student in his classroom before school the following morning, and investigators say the victim later reported that he kissed and sexually assaulted her. A judge sentenced him to 10 years in prison followed by 10 years of sex offender probation, drawing on courtroom statements from the sentencing hearing and Hillsborough County court records.
Prevatte had faced a maximum sentence exceeding 100 years in prison had he been convicted on all original charges, a potential exposure tied to Florida Statute § 775.0862, which imposes enhanced penalties on school employees, volunteers, or contractors classified as authority figures over students, per the Sammis Law Firm. Under Florida Statute § 800.04, consent is not a legal defense for victims under 16, and an offender's mistaken belief about a victim's age cannot be raised in lewd or lascivious battery prosecutions, according to the statute published on Online Sunshine.
An Investigation That Predated His Classroom Assignment
Court records and investigative reporting show law enforcement scrutiny of Prevatte began before he ever worked at Lennard High. The Hillsborough County Sheriff's Office had already opened an investigation into Prevatte in September 2024 involving an elementary-age child, separate from his public school employment, according to WTSP.
Deputies formally arrested Prevatte on November 18, 2024, booking him on one count of lewd or lascivious battery and one count of harmful explicit communication to a minor, following his three-day teaching assignment at Lennard High, per the same outlet's reporting. Prevatte had been hired and assigned to Hillsborough County Public Schools through Kelly Education, a third-party staffing firm contracted by the district to recruit and manage substitutes. Under state and agency standards, Kelly Education substitutes must undergo Level 2 FDLE fingerprinting, National Sex Offender Registry checks, drug screening, and pre-screening safety training requiring an 80% passing score, according to WKMG.
Pending Charges Remain in Manatee County
Prevatte also worked as a substitute teacher in Manatee County, where investigators have said he allegedly sent inappropriate messages to high school students. That case is still pending, according to attorneys cited in the Fox 13 News report. The Manatee County investigation began on October 31, 2024, after an anonymous tip submitted through Florida's FortifyFL app alleged Prevatte exchanged Instagram messages and sent a cropped nude photo to a local high school student, WTSP reported.
The FortifyFL reporting tool that flagged the alleged Manatee County conduct was created and funded by the Florida Legislature under the 2018 Marjory Stoneman Douglas High School Public Safety Act, and it automatically routes tips to police and school officials, according to FortifyFL. After the November 2024 investigation, Hillsborough County Sheriff's deputies proactively notified school district authorities in Pasco, Pinellas, Polk, and Hernando counties to keep Prevatte from seeking teaching assignments elsewhere in the Tampa Bay area, per WTSP's report.
Defense Cited Military Trauma; Charges Denied in Part
At sentencing, Prevatte's attorney requested a much lighter sentence, and a doctor testified that Prevatte experienced a high level of trauma from childhood and decades of military service, with that trauma and service contributing to some of his behavior, according to the doctor's testimony as reported by Fox 13 News. Prevatte was an active-duty Army Reserve Master Sergeant serving as an intelligence noncommissioned officer assigned to a Reserve detachment with Special Operations Command since March 2022, according to Task & Purpose. It remains unclear whether military disciplinary proceedings or a discharge were initiated against him.
Prevatte admitted to messaging the student and to adding a student on Facebook, though he denied having sent the student sexual or romantic messages. Addressing the court, Prevatte said his actions brought dishonor to himself, his future wife and his children, saying, “The immense degree of regret and further remorse that I carry as a result of my actions will forever loom over my life.”
