A Louisville man accused of killing his girlfriend and her teenage daughter is now facing 23 additional felony counts involving alleged rape, abuse and sexual exploitation of juvenile victims, including a count involving a minor under 16. Tobias Malone, 28, was indicted by a Jefferson County grand jury on July 30 and is scheduled to face the new charges in court Monday morning.
According to WAVE, the new indictment includes one count of first-degree rape, one count of first-degree sexual abuse, one count of promoting a sexual performance by a minor and 20 counts involving material portraying a sexual performance by a minor. Malone is scheduled for arraignment at 10:30 a.m. Monday and remains in Louisville Metro Department of Corrections custody.
New indictment follows Portland neighborhood killings
Malone was already charged in the June 2 deaths of Vienna Peoples and her teenage daughter, Labria Miller, who were found inside a home in Louisville’s Portland neighborhood. Family members told WLKY that Peoples and Malone were dating, and police said the killings appeared to be domestic violence-related. The homicide case includes two murder counts and one count of tampering with physical evidence. The public report on the new indictment does not identify the alleged child victim, and the sexual-abuse charges are separate allegations that have not been proven in court.

Earlier hearing detailed investigators’ account
A June hearing was part of the homicide case's proceedings. As previously reported by WAVE, the detective also said Malone described discarding the gun and damaging a victim’s cellphone after the shooting.
The earlier hearing sent the homicide case to a grand jury, which has now expanded the criminal case with the child-related charges. The additional counts followed a grand jury hearing.
Malone remains jailed as case moves forward
A judge previously set Malone’s bond at $1 million after his arrest in the killings, according to WDRB. He pleaded not guilty to the original charges.
Monday’s arraignment is scheduled for 10:30 a.m. Malone is presumed innocent unless prosecutors prove the allegations beyond a reasonable doubt.
