A 37-year-old Sonoma County woman has sued the Guerneville School District, alleging that longtime teacher Keith Wilson sexually abused her when she was an eighth grader. The complaint, filed under the name Jane Doe, says Wilson used a tutoring van parked on campus to isolate and assault her when she was 13 and 14. Wilson died in 2003.
The lawsuit was filed Aug. 20 in Sonoma County Superior Court, according to The Press Democrat. It accuses the district of negligent supervision, hiring and retention, and failing to warn, educate and train staff. Doe alleges Wilson offered her passing grades in exchange for sex and used an intoxicating or incapacitating beverage during an assault. Wilson taught in Guerneville for 32 years and died in May 2003 at age 58, after suffering irreparable brain damage from a cerebral hemorrhage.
Allegations of a Van, a Mattress, and Missed Warnings
The complaint alleges school officials knew Wilson invited girls into his van and that a mattress was inside. It accuses the district of failing to supervise his contact with students, investigate his conduct, report him to law enforcement or terminate him, despite what the filing characterizes as actual or constructive notice that he posed a risk to children.
Doe alleges that adequate supervision or timely reporting could have prevented some or all of the abuse. The complaint also says Wilson told her she was pretty and had nice breasts for her age, and alleges that his conduct put other students at risk during his decades on staff. These are allegations in the lawsuit, not findings by a court.
Attorney Says Doe Disclosed Abuse Around Time of Wilson's Death
Doe's attorney, Alex Cunny, told The Press Democrat that his client disclosed the abuse to a teacher around the time Wilson died. The lawsuit seeks unspecified damages and argues that Doe's claims are timely under the applicable statute of limitations.
The Press Democrat reported that California currently has no statute of limitations on child sex abuse claims. It also reported that claims predating a 2024 change had to be filed before a victim turned 40 or within five years of recognizing or reasonably discovering the harm. The district's legal counsel told the newspaper it could not comment on the pending litigation.
School reporting duties and a separate court precedent
A 2011 California Commission on State Mandates analysis identified an obligation, with a reimbursement period beginning July 1, 2000, for districts to report to the state when specified employees did not receive mandated-reporter training. That record does not establish what Guerneville officials knew or did. A separate 2023 decision by the California Court of Appeal, Fourth District, Division 2, said the record supported a trial court's finding that a Victor Valley school district was on notice litigation was reasonably foreseeable when video related to allegations of student-on-student sexual assault was erased. The opinion, reproduced by FindLaw, concerned video preservation and sanctions, not district liability for teacher abuse.
Case Heads to Sonoma County Courtroom Next Year
A case management conference is scheduled for Feb. 9, 2027, before Sonoma County Judge Patrick Broderick. The Guerneville School District is led by Superintendent Joelene Morasch.
The Guerneville case is separate from other lawsuits alleging school districts failed to respond to warning signs. In 2024, 25 former students who said they were sexually assaulted by teacher Mark Berndt sued the Los Angeles Unified School District, according to PR Newswire. The next scheduled step in the Guerneville case is the February 2027 conference.
