A man in his 30s was shot multiple times early Friday morning after two masked intruders broke into his home on the 3100 block of 20th Street West in Jacksonville, according to police. Officers found him with gunshot wounds to both arms and his back, and he was taken to a hospital, where his injuries are considered not life-threatening.
The home invasion happened in the Allendale neighborhood on Jacksonville's Westside, according to News4JAX, which reported that officers responded to the residence around 3:40 a.m. and found the victim wounded before rushing him to a local hospital, where he is expected to recover. Police say the man struggled with one of the masked intruders during the break-in, according to a police news release cited by Action News Jax. Both suspects fled before officers arrived, and as of Friday morning, no arrests had been announced.
Masks and a Getaway Complicate the Investigation
Because the intruders covered their faces and got away before police showed up, investigators are leaning on neighborhood surveillance footage and tips from residents to piece together who was involved. Home-invasion robbery committed with a firearm is a first-degree felony under Florida Statute § 812.135, punishable by up to life in prison and carrying a statutory minimum of 66 months, according to the Florida Legislature's statutes. Because the victim was shot and injured, the state's 10-20-Life law, Florida Statute § 775.087, would also apply, mandating a minimum prison term of 25 years to life without gain time for discharging a firearm and causing injury during an enumerated felony.
Florida law also recognizes that homeowners have a legal presumption of reasonable fear when confronting an unlawful, forceful intruder inside their own home under Florida Statute § 776.013, which removes any duty to retreat.
