An 18-year-old man is facing capital murder charges after Houston police say he tried to rob another man in a Northeast Houston parking lot early Sunday, shot him during a struggle, and the wounded victim crashed into a utility pole while trying to flee. Diego Gene Torres was booked into the Harris County Jail after allegedly admitting his role in the shooting during police questioning.
According to ABC13 Houston, officers responded to a person-down call at 10100 Mesa Drive around 1:20 a.m. Sunday and found an unconscious man suffering from multiple gunshot wounds in the driver's seat of a vehicle that had struck a pole. Paramedics pronounced him dead at the scene. Surveillance video later revealed that the shooting happened in a parking lot at 9905 Mesa Drive, where investigators say Torres and the victim first crossed paths.
Investigators believe Torres tried to rob the victim in that parking lot, and that the two struggled before Torres shot him. The wounded man then attempted to drive away, only to crash into the pole on Mesa Drive a short distance later. The victim's identity remains pending notification of family members by the Harris County Institute of Forensic Sciences.
How Detectives Tracked Down the Suspect
Detectives found Torres's vehicle after the shooting. Once the car was found, Torres was detained, and investigators say he admitted his role in the killing during questioning. The Harris County District Attorney's Office subsequently accepted capital murder charges against him.
Judge Hilary Unger was first elected to the 248th Criminal District Court in November 2018, per Justex records. Under Article I, Section 11 of the Texas Constitution, judges may deny bail to defendants accused of capital offenses when proof of guilt is evident. That provision addresses bail eligibility in capital cases.
What Capital Murder Charges Mean for the 18-Year-Old
Texas law draws a sharp line between ordinary murder and capital murder. Investigators say Torres tried to rob the victim, and the Harris County District Attorney's Office accepted capital murder charges against him. Under Texas Penal Code § 19.03(a)(2), a killing becomes capital murder when it happens during the commission or attempted commission of a robbery, according to the Barbieri Law Firm. Standard murder convictions in Texas carry sentences ranging from five to 99 years or life in prison; a killing during a robbery is capital murder only when specified aggravating circumstances are present.
For adult capital murder convictions, Texas Penal Code § 12.31 limits sentencing to just two outcomes: life imprisonment without the possibility of parole, or the death penalty. There is no middle ground in Texas capital cases involving adult defendants.
A Corridor With a Troubled Recent History
The shooting adds to a string of violent incidents along the Mesa Drive corridor, a major arterial road running through the Trinity/Houston Gardens neighborhood in Northeast Houston. Hoodline has previously reported on prior fatal gun violence in the area, including a September 2024 homicide in the 5100 block and a December 2022 robbery shooting nearby in the 8600 block.
