
Fresno Police officers raced to East Dudley Avenue and North Broadway Street in the Tower District at 3:19 a.m. Friday after ShotSpotter sensors and several 911 callers reported a single gunshot. When they arrived, they found a 72-year-old homeowner and his daughter at the scene, an off-duty ICE agent shot in the stomach, and a second off-duty law enforcement officer already holding the agent in handcuffs.
According to 6abc Philadelphia, the agent, identified as 32-year-old David Gonzalez, is a federal officer from Texas assigned to Immigration and Customs Enforcement. Police say he was found asleep on the woman's front lawn before 3:30 a.m., appeared drunk, and assaulted the 72-year-old homeowner when the man confronted him. The homeowner's daughter tried to intervene to protect her father, and police say Gonzalez physically attacked her as well before the homeowner used a gun to defend them both.

The off-duty officer who handcuffed Gonzalez before patrol units arrived was the daughter's boyfriend, who reached the house shortly after the gunshot was fired, the same SFGATE report notes. Gonzalez was taken to a local hospital, where he was listed in serious condition and remained in custody. He was arrested on felony assault charges, and police say the 72-year-old homeowner will not face charges for the shooting. Investigators say they are still looking into why Gonzalez was in the neighborhood in the first place.

ABC30 reported that Arias and another local elected official alleged ICE requested Gonzalez’s release, while Fresno police denied that any request was made. Fresno Police's decision not to charge the homeowner traces to California's self-defense standard, under which a person has no legal duty to retreat and may use reasonable force to stop an imminent threat anywhere they are lawfully present. That standard differs from California's Castle Doctrine under Penal Code Section 198.5, which creates a presumption that an intruder poses a deadly threat in a residence, according to Shouse Law Group.
This is not the first time an off-duty ICE agent's actions have drawn scrutiny in California this year.
