Indio’s proposal to let festivalgoers carry alcoholic drinks in parts of downtown remains undecided. After discussing the idea on October 8, the City Council sent it back to staff to develop additional options, with another discussion scheduled for October 21, 2026.

As described by NBC Palm Springs, the proposal would allow people to buy beer or cocktails from participating downtown businesses and carry them in designated areas during events. The draft calls for wristbands to verify that drinkers are at least 21 and city-approved clear plastic cups. The council has not approved those terms.

Council Sends Plan Back for More Work

Council members asked staff to consider a smaller designated drinking area and alternatives that would not involve open containers, according to the same report. Those options are expected to return to the council later this month.

Events named in connection with the proposal include the Indio International Tamale Festival, a long-running downtown tradition. The city’s own website describes the 34th Annual Indio International Tamale Festival as scheduled for December 5 and 6, 2026, according to City of Indio, promoting it as a family-friendly gathering with live entertainment, local vendors and tamales shared with an expected crowd of thousands.

Commentators Offer Different Views

On The Roggin Report, panelists Chauncey Thompson and Tammy Bleck offered brief, opposing reactions: Thompson saw alcohol as a possible draw for local events, while Bleck questioned whether festivals need it and whether drink limits would be workable.

The council’s decision remains pending; the panel discussion did not change the options staff is preparing for its next review.

What the State Requires for Event Alcohol

Any such arrangement would still have to clear state rules. Each permit type requires a licensee to obtain authorization from the department before every event, and only specified on-sale license holders may apply for an Event Permit, as reported by California Department of Alcoholic Beverage Control. The agency's guidance on entertainment zones also notes that an established zone is what authorizes consumption of alcoholic beverages on public streets, sidewalks or rights-of-way within defined boundaries, as noted by California Department of Alcoholic Beverage Control.

State Law Leaves the Choice to Indio

A California Senate Third Reading analysis of SB 969 says the law authorizes qualifying license holders to participate in entertainment zones under specified conditions, but does not require local governments to create them. Indio would still need to adopt its own ordinance. Event permits and entertainment zones are separate mechanisms. California ABC guidance says consumption on public streets, sidewalks or rights-of-way is allowed within an established entertainment zone, and participating licensees must meet agency requirements. The existence of that state framework does not mean Indio has approved a zone.

For now, the question of whether Indio’s downtown festivals will actually see clear cups and wristbands in action remains unresolved. The council’s next scheduled discussion, on October 21, will determine what — if anything — moves forward from here.
