A 16-year-old girl is suing Cuban rapper Chocolate MC, a Las Vegas nightclub and Boyd Gaming Corp., alleging she was given alcohol and cocaine before the performer sexually assaulted her inside his hotel room at The Orleans during a 2024 New Year's Eve party. The rapper, whose legal name is Yosvanis Sierra Hernandez, is incarcerated in Florida in connection with an attempted murder-for-hire plot.

Attorneys for the teenager filed the civil suit in Clark County District Court on Tuesday, according to the Las Vegas Review-Journal, which reported on the complaint. The lawsuit accuses Sierra Hernandez — who performed at Masque Nightclub's New Year's Eve festivities that night — of sexual battery and intentional infliction of emotional distress, claiming the teen's drug and alcohol use substantially impaired her ability to understand, evaluate or resist what was happening, and alleging sexual conduct or penetration without her consent.

According to the complaint, the teenager was allowed into the club and permitted to obtain and consume alcohol and illicit drugs, and the lawsuit further alleges Sierra Hernandez furnished and encouraged her continued use of drugs and alcohol before escorting her back to his hotel room at The Orleans. The complaint names 13 causes of action, and attorneys for the plaintiff are seeking more than $15,000.

Nightclub and Casino Named as Co-Defendants

The complaint alleges Masque Nightclub admitted the underage plaintiff, provided her alcohol and was negligent. Boyd Gaming Corp. — which operates The Orleans — is accused of failing to protect the plaintiff and of negligent employee hiring and training. David Strow, vice president of corporate communications at Boyd Gaming, declined to comment on the legal complaint, per the Review-Journal's report. Boyd Gaming is a major Las Vegas-headquartered operator that manages 28 entertainment properties across the country, according to Gambling911.

Masque Nightclub is located on South Procyon Avenue.

Why the Case Skips Arbitration

The civil action will also proceed outside Nevada's standard court-diversion process. Under Assembly Bill 3, enacted in 2025, civil claims in Nevada District Courts for which the probable jury award is up to $100,000 are normally routed to mandatory non-binding arbitration — but claims alleging sexual assault or sexual battery are automatically exempt, per Communique Magazine. That exemption means the lawsuit against Sierra Hernandez, Masque Nightclub and Boyd Gaming will move through the standard district court track rather than arbitration.

A Rapper Incarcerated in Florida

Sierra Hernandez is incarcerated for his role in an attempted murder-for-hire plot in Florida. A Miami-Dade jury found him guilty in a case involving an online offer of $20,000 for a killing, according to CBS News. Damian Valdez-Galloso has been accused of killing Cuban reggaeton musician José Manuel Carbajal Zaldívar, known as El Taiger.

A separate Opa-locka incident involved allegations that Sierra Hernandez pointed a gun at a fan before fleeing in his own car.
