
A 20-year-old man is facing a felony charge after an arrest at a McDonald's in Mountain View, Arkansas. George David Barnett was arrested after allegedly threatening to get the Aryan Brotherhood to kill police.
According to a probable cause affidavit cited by White River Now, Mountain View police were dispatched to the McDonald's and Circle K parking lot on East Main Street after a sergeant had already ordered Barnett to leave the property earlier that day. An officer located Barnett, the affidavit states.
Per the KTLO report, Barnett was arrested after threatening to get the Aryan Brotherhood to kill police.
Threats Escalate During Arrest
KTLO reported that Barnett threatened to get the Aryan Brotherhood to come to Mountain View and kill police.
This was not Barnett's first run-in with Mountain View police this fall. Barnett had also been arrested on Sept. 27.
Felony Charge Carries Years-Long Exposure
Barnett now faces a terroristic-threatening charge along with counts of resisting arrest, disorderly conduct, and criminal trespassing, KTLO reports.
Under Arkansas Code § 5-13-301, first-degree terroristic threatening is a Class D felony, carrying a maximum sentence of up to six years in prison, according to Wesley Rhodes, Attorney at Law. The other counts are resisting arrest, disorderly conduct, and criminal trespass, per the same White River Now report.
Arkansas appellate precedent sets a specific bar for prosecutors pursuing the felony charge. Under FindLaw's coverage of Hughes v. State (2020), prosecutors must prove a defendant acted with the specific intent of filling a victim with intense fright, a standard that courts have said can be inferred from the surrounding circumstances.
