The abuse took place at a home on Crackel Road in Aurora between July 2016 and July 2019, according to the Record-Courier. The victim was between 7 and 9 years old during that period, and Kainec was accused of abusing her while she and her mother were living with him. In a written statement, Prosecutor Connie Lewandowski said plainly: “This child was 7, 8, and 9 years old when he raped her.”

The girl did not report the abuse until she was 14, and she testified during the trial, which took place in July 2026. The defense argued there was no corroboration, no eyewitness testimony, and no physical or medical evidence tying Kainec to the alleged crimes. Prosecutors countered that the girl had no motivation to lie. Kainec himself denied the accusations. His attorneys did not comment on his behalf after sentencing, and Kainec declined to make a statement on their advice because of the likelihood of an appeal.

Prosecutors Describe Lasting Harm to the Victim

Michniak had asked the court for the maximum sentence allowed by law, telling the judge that Kainec showed no remorse throughout the proceedings. “He has shown no remorse throughout all of this and he has done irreparable harm,” he said. The victim's mother told the court the abuse has affected her daughter's trust, her acceptance of affection, her body image, and her understanding of relationships.

According to the account relayed in court, the girl now lives with debilitating anxiety and panic, takes daily medications, and is already in therapy while she waits to begin specialized trauma therapy. During sentencing, Doherty addressed the victim directly, telling her she was brave and should use the experience to move forward.

Lifetime Registration Requirements

Doherty also declared Kainec a Tier III sex offender, the state's most serious registration classification. She explained that state law requires the court to detail the registration requirements that come with the designation: Kainec must register with the sheriff of any county where he lives, works, or attends school every 90 days for the rest of his life.
