Athai Lee Muon faces three counts of first-degree criminal sexual conduct and two domestic assault charges after a woman accused him of coming to her home unannounced, being allowed inside, strangling her and sexually assaulting her. At his first appearance in Olmsted County Court, Muon was ordered held on $100,000 bail or bond.
The criminal complaint identifies the woman as Muon's former girlfriend. The alleged incident took place at a residence in northwest Rochester on October 4, according to WJON. postbulletin.com reported that Rochester police spoke with the woman on October 6 after she said Muon visited her home over the weekend and assaulted her.
What the Complaint Alleges
Muon came to the home unannounced, and the woman allowed him inside. The complaint alleges he took the woman's phone. She told police he squeezed her neck so tightly that she temporarily could not breathe, slapped and pinched her, and gripped her right elbow. Officers later observed bruising on the elbow, according to the complaint.
The woman told investigators she resisted the alleged sexual assault and said “no” and “stop,” according to the complaint.
Charges and Bail
Muon was charged with three counts of first-degree criminal sexual conduct, one felony count of domestic assault by strangulation and one gross misdemeanor domestic assault charge. Bail was set at $100,000 at his Olmsted County Court appearance. Under Minnesota Statute 609.2247, assaulting a family or household member by strangulation is a felony punishable by up to three years in prison, a fine of up to $5,000, or both, according to the Minnesota Revisor's Office.
First-degree criminal sexual conduct charges, outlined under Minnesota Statute 609.342, apply when a person engages in penetration or sexual contact under specified circumstances defined in the law, per the Minnesota Revisor's Office. Reporting on Muon's age differs between outlets: postbulletin.com identifies him as 28, while WJON lists him as a 27-year-old Rochester man.
Prior Domestic Assault Case
Court records show Muon has an unresolved domestic assault case from May 2026 in which he allegedly injured a woman and knocked her phone away to stop her from calling 911, the report notes. He was also convicted in June 2026 of violating a domestic assault no-contact order, according to the same source.
