UNO and Delta Chi are investigating a fraternity member after a recording from an off-campus toga party on Oct. 2 circulated, The Gateway reported. The outlet said the member is a senior and, according to three anonymous sources, serves on the chapter’s executive board. The Gateway has not named him. It reported that he has not been charged with a crime and did not respond to the reporter’s emails or texts.

The recording captures the member making a remark about rape, followed by another fraternity member warning that it should not be put on video, according to The Gateway. A UNO freshman told the outlet the footage was made on her phone without her permission while it was left unattended at the party. The Gateway reported that she described the experience as triggering as a sexual assault survivor.

Delta Chi International, headquartered in Indianapolis, condemned language referencing sexual violence, opened an internal investigation and referred the matter to the chapter’s judicial board, The Gateway reported. The organization also said it would cooperate with any investigation.

UNO’s Student Code of Conduct says allegations of sexual misconduct are handled under Executive Memorandum No. 38, according to the university catalog. UNO’s Title IX FAQ says respondents are presumed not responsible and that university proceedings are separate from criminal or external investigations. It also says university proceedings use a preponderance-of-the-evidence standard, and that a person may report to police without filing a formal Title IX complaint, according to the university’s Title IX office.
