According to ABC13 Houston, a Harris County Precinct 4 deputy constable is facing a solicitation of prostitution charge after Houston police say he showed up to meet an undercover officer he'd allegedly agreed to pay $50 for oral sex. Davien Montgomery was arrested Monday in the 3300 block of Tidwell Road in northeast Houston, where officers were running an undercover prostitution sting, and he appeared before a magistrate Tuesday morning as the case against him moves forward.

According to ABC13, Montgomery currently works for Harris County Constable Precinct 4. Court documents allege he solicited oral sex from an undercover officer and agreed to pay $50, and court records state that the two then arranged to meet at a nearby motel. Police said Montgomery was arrested once he arrived at that agreed-upon location.

Magistrate Finds Probable Cause

At his initial court appearance Tuesday morning, a magistrate found probable cause to move the case forward, telling Montgomery, “I find there is enough probable cause. I will send you to court.” As noted by ABC13 Houston, the magistrate noted he had one charge on the docket for solicitation of prostitution. When asked about legal representation, Montgomery declined a court-appointed attorney, responding simply, “No, sir.”

The solicitation of prostitution charge against Montgomery remains pending, the station's report notes. As of Tuesday, Mark Hermann's office had not responded to a request for comment from the outlet's reporting.

How Houston-Area Stings Have Played Out Before

Undercover prostitution stings have periodically swept up large numbers of people across the Houston region. In nearby Montgomery County, district clerk records showed 26 men were arrested and charged with soliciting prostitution during a two-day operation in early December 2021, according to the Houston Chronicle. Charging documents from that sting listed the offense as a state jail felony, with most of those arrests happening in a single day.

The Chronicle also reported that a central Montgomery County sting that September netted 13 arrests, while an operation that April led to 27. An earlier sting in the Kingwood area resulted in 79 arrests in late summer 2019, underscoring how frequently local law enforcement has targeted solicitation activity in the broader Houston area.

For now, Montgomery's case remains in its early stages, with the charge still pending and no response yet from Precinct 4 leadership.
