Fitness influencer Bradley Martyn is facing a restraining order request from model Noelle Leyva, who alleges he hit her across the chest and shoved her to the floor during a Los Angeles Halloween party. Leyva says the confrontation left her scared, anxious and fearful for her life, while Martyn's attorney insists his client categorically disputes her version of events.
What Leyva Alleges Happened
According to TMZ, the alleged confrontation happened around 12:30 a.m. at a Halloween party hosted by boxer Ryan Garcia and streamer N3on. Leyva claims a girl called her over to talk at the party, and that Martyn then told her to leave before hitting and pushing her. Per her application for a civil harassment restraining order, as detailed in a New York Post report, Martyn allegedly hit her across the chest and shoved her to the floor.
Leyva's filing reportedly notes the altercation left no visible markings on her body, but she said she felt scared, anxious and humiliated after the incident. TMZ's report states that three witnesses provided statements supporting her account, with one claiming Martyn used both hands to shove her backward. Separately, per the Post's account of the filing, Leyva's boyfriend, Colin Hughes, wrote that Martyn forcefully shoved Leyva and that she fell on the stairs, adding that she had not physically provoked him; Hughes and other people reportedly submitted sworn statements to the court saying they witnessed the altercation.
A Years-Old Business Dispute
Leyva says she met Martyn roughly five years before the Post's report, when she was 20 and he was 32. She alleges Martyn told her he could help her become more famous and earn more money, and the two entered into a business agreement. Leyva ended that arrangement in 2023, according to the Post, and Martyn subsequently sued her over her exit from the deal before dismissing the lawsuit in May of that year.
Leyva alleges in her filing that Martyn held a grudge against her for years over the failed partnership, and that he told friends and acquaintances he wished her dead over what she had done to him. She said she initially did not take his threats seriously. The Post's report notes Martyn had more than 4 million Instagram followers at the time, per Leyva's filing.
What Leyva Is Asking The Court To Order
Leyva has asked the court to order Martyn to stay at least 50 yards away from her, her home, her job and her vehicle. She also wants the court to bar him from vilifying her on social media directly or through proxies and from posting negative commentary about her, her life and her friends. Under California law, courts statewide rely on a common set of forms for this type of petition, according to the California Courts Self Help Guide.
Martyn's Attorney Pushes Back Hard
Martyn has denied the allegations. His attorney, Charles Lew, said Martyn categorically disputes Leyva's account of what occurred on October 29, and said multiple witnesses present would corroborate Martyn's version instead. Lew went further, calling the petition an ill-advised and duplicitous attempt to extort money from his client, according to the Post's reporting.
Police Investigation And Unresolved Timeline
TMZ reports that a battery report was filed with the Los Angeles Police Department on October 29 and that detectives were investigating the incident, though no charges had been announced. The New York Post dates the Los Angeles gathering where the alleged incident occurred to October 29.
The Post's report includes physical descriptions from the filing: Martyn is roughly 6 feet 3 inches tall and weighs about 260 pounds, while Leyva is roughly 5 feet 4 inches tall and weighs about 100 pounds. Leyva is 25; Martyn is 37.
