
Jose Cruz Noguez, a 49-year-old man from Mexicali, Mexico, has been sentenced to 15 years in prison for organizing a fatal smuggling event near Calexico, California, that resulted in the tragic deaths of 13 undocumented migrants on March 2, 2021, according to the United States Department of Justice. The accident occurred when the vehicle carrying the migrants collided with a tractor-trailer near Holtville, California, and Noguez played an aggravated role in the smuggling operation, which was deemed particularly "tragic and heartbreaking" by U.S. District Judge Cathy Ann Bencivengo.
Noguez admitted to being the coordinator of the event where two SUVs, a GMC Yukon and a Ford Expedition, were modified by removing the passenger seats, allowing for undocumented migrants to be stacked on top of one another. He was responsible for organizing the event, collecting payment from the smuggled individuals, and recruiting at least one of the drivers. Noguez also scouted the smuggling route to avoid law enforcement activity, in the hopes of slipping past the authorities undetected but at a cost that turned out to be too high for 13 unfortunate victims.
In a press release from March 21, 2023, the Department of Justice reveals that Noguez pled guilty to the charges stemming from this tragic event, admitting that he and his co-conspirators sought to smuggle numerous undocumented migrants into the United States and in the days leading up to the calamitous incident; they loaded them into the modified SUVs, breaching an area of the international boundary fence between Mexico and the United States, near Calexico, California.
As the two SUVs entered the United States, the GMC Yukon began filling with smoke and eventually caught fire, causing the driver to abandon the vehicle and flee. The smuggled individuals were left to deal with the emergency themselves. Things took an even darker turn when the Ford Expedition, carrying 24 occupants, collided with a tractor-trailer at the intersection of Norrish Road and Highway 115, leaving 13 dead and many more survivors seriously injured, what a horrendous outcome to a scheme that appeared to be promising from the beginning, at least for those who came to seek refuge in search of a better life, escaping dire situations, and Noguez had the audacity to try to collect payment from the surviving aliens who did not get caught by law enforcement, a demonstration of his sheer callousness.
Judge Bencivengo, who presided over the sentencing hearing, expressed her hope that the statutory maximum sentence would serve as a "message to the trafficking community" and would emphasize that there are serious consequences for engaging in "gross behavior" and treating people like human cargo, and U.S. Attorney Randy Grossman added that the heinous conduct displayed by Noguez and his co-conspirators would not be tolerated. They showed no concern for the health and safety of the individuals they smuggled, treating them like "a worthless commodity" and cramming them into vehicles with no seats or restraints, inflicting unimaginable pain and suffering, and had they spared a moment to think about their potential victims and the dangers they were exposing them to in this kind of operation, maybe, just maybe, this tragedy could have been avoided.
Noguez was initially indicted on April 27, 2021, and following further investigation, a Third Superseding Indictment was filed against him and another individual (who remains a fugitive) on July 15, 2022, according to the Department of Justice; his trial had been scheduled to begin on May 15, 2023. He opted for a plea agreement and pled guilty to one count of Conspiracy to Bring in Undocumented Migrants and three counts of Bringing In Undocumented Migrants for Financial Gain, which carry a mandatory minimum sentence of five years, thus cutting his trial short and facing the consequences for his fatal actions, for his role in this grievous human smuggling incident, that led to the loss of 13 innocent lives and caused immense suffering for the surviving victims who were left limbless.
