Menin's lawsuit, filed on Tuesday in federal court in Boston, showcases screenshots of her initial response on June 23, 2023, to automated texts informing her of the option to opt-out by replying "STOP." However, the unwanted messages persisted through July 14, a violation of the Telephone Consumer Protection Act (TCPA).

This federal law dictates that companies must offer individuals the ability to opt out of receiving marketing text messages and can face substantial fines, up to $1,500 per illegal message, for failing to comply, CBS News Boston states.

The lawsuit goes a step further to demand statutory damages for those who received marketing text messages from Star Market after opting out during the last four years.
