
In a landmark ruling that has paved the way for cyclists and pedestrians injured by uninsured motorists, the Illinois Supreme Court has declared they are entitled to coverage, marking a significant shift in insurance law. Fredy Guiracocha, on behalf of his son Chris, who was struck by an unidentified vehicle while biking in Chicago, has emerged triumphant in a case that sets a precedent for future claims across the Prairie State.
Chris, then just 14, found himself entangled in a legal battle after Direct Auto Insurance denied his claim, citing policy language restricting coverage to insured individuals in an insured automobile—a condition that did not encompass young Chris, who was injured while riding his bike. According to an article by the Chicago Sun-Times, the state's high court found this exclusion to violate both Section 143a of the Illinois Insurance Code and public policy, thereby rendering it unenforceable.
Lead attorney Jonel Metaj acclaimed the decision as a watershed for the citizens of Illinois. "We are thrilled for our clients, we’re thrilled that we are setting a law that essentially affects all citizens because we all have insurance; we don’t want these auto insurance companies to be able to restrict coverage," Metaj told Chicago Sun-Times.
The Direct Auto policy held by the Guiracochas was meant to cover family members but found itself up against a formidable legal opponent that did not yield until reaching the apex of Illinois courts. After the accident witnessed by a driver who had no insurance, which left the young Guiracocha with injuries that immobilized his right side for half a year, the Supreme Court's ruling shines as a beacon of hope. "I was really happy about it to be honest," Guiracocha conveyed his emotions to WLS. "I was at work when we got the call. Anything will help. Anything we get out of it."
The case, having ricocheted from the Cook County Circuit Court to the appellate level and finally resting at the bench of the state's highest court, has irrevocably altered the landscape – every insured person struck by a hit-and-run or uninsured driver in Illinois can now rest assured that their insurance shall offer the sanctuary promised.
