The now-dismissed battery charge stemmed from an incident involving Michael Steel, a fellow police officer, who later made contradictory statements about whether the tasing was intentional; Steel first informed emergency room staff that the taser discharge was accidental complicating the prosecution's case and leading to the eventual dismissal, per details obtained from BNN Breaking News. Following the dropped charges, Rick Diaz, Perez's attorney announced plans to seek his client's reinstatement and intends to challenge Steel's credibility, pushing for de-certification due to false statement claims and also pursue potential lawsuits for malicious prosecution and against Opa-locka city for what he suggests was negligent hiring.
Acknowledged by the Miami Herald, Captain Perez is known for his contentious past; he was involved in a high-profile deadly car chase in 2015 and more recently faced battery charges in November 2022 pertaining to an alleged incident involving a mentally ill teen, which currently remains unresolved and has sparked a federal lawsuit against him and the Opa-locka Police Department.
