
The legal battle stemming from a violent incident involving teenagers outside an In-N-Out restaurant in Gilbert is escalating, with a father's notice of claim naming the Chandler Unified School District (CUSD), a School Resource Officer (SRO), and the Gilbert Police Department. Rick Kuehner seeks $6 million in damages after his son was attacked on August 18, 2023. Court documents obtained by ABC15 allege that school staff and the SRO knew of, yet failed to properly handle, threats to Kuehner's son, including images of firearms shared by other students.
Despite the incident's inactivity on official records for months, questioning from ABC15 in December prompted a renewed push in the case. By January this year, police had arrested six individuals. Meanwhile, the notice of claim slams the response from CUSD and the SRO for being "deplorable," as they allegedly took minimal action—such as reassigning a seat—instead of expelling or arresting the students who made death threats and carried out the attack. The school district and the Gilbert Police Department have refrained from commenting on the ongoing litigation.
This week, Gilbert police have upped the ante in their response, making two additional arrests related to the assault at the burger joint. According to ABC15, 19-year-old Deleon Haynes and another 17-year-old suspect now face charges of aggravated robbery and assault, alongside the previously indicted Christopher Fantastic and Aris Arredondo, both 18 and two 16-year-olds. Fantastic and Arredondo are being held on $25,000 secured bonds, with court proceedings for the juveniles directed to the Maricopa County Juvenile Court.
Maricopa County Attorney Rachel Mitchell has taken action against the violence with public indictments: Fantastic on January 19, and Arredondo on January 22 for similar charges. This legal reckoning follows ongoing investigations by ABC15 into teen violence in the East Valley, spotlighting the need for accountability and protection in the area's schools and communities.
