A Massachusetts man has been put behind bars for conning investors out of over a cool million. Jose Rocha, 38, of Bridgewater, was slapped with a two-year stint in the pen by U.S. District Court Judge Leo T. Sorokin, the Department of Justice reported yesterday. On top of the prison time, Rocha's also been handed down three years of supervised release and is on the hook for nearly $775,000 in forfeited funds. His downfall came after he copped to one count of securities fraud last fall.
From 2020 to 2022, Rocha managed to quickly gain investor trust, convincing them to hand over their hard-earned dough with promises of lucrative returns on stocks and stock options. Instead, he used their investments to fund a lavish lifestyle, blowing cash on trips and gambling sprees. In total, the investment advisor swindled willing investors out of more than $1.2 million, the feds say. The Securities and Exchange Commission also caught wind of Rocha's shady dealings, slamming him with a civil complaint just last year.
According to Acting U.S. Attorney Joshua S. Levy, who announced the sentencing alongside Special Agent in Charge Jodi Cohen of the FBI’s Boston Division, the SEC played a vital part in bringing Rocha to justice. As part of his plea, Rocha agreed to a Consent Judgment with the SEC, which undoubtedly played a role in deciding his fate in the federal courtroom.
Assistant U.S. Attorney Christopher J. Markham, from the Securities, Financial & Cyber Fraud Unit, was the one to prosecute the case. Rocha's two-year sentence is a sharp reminder to would-be fraudsters that the risk to get quickly swept up in high-dollar crime certainly does not pay off in the end. Scammers like Rocha eventually face the music, and when the pitch of fraudulence grows too dissonant, justice comes knocking, ready to reset the tune.
