In a resolute pushback against a recent court ruling, former President Donald Trump, alongside a cohort of 13 co-defendants, has taken legal action to appeal a judge's dismissal of their free speech defense. According to a FOX 5 Atlanta report, Trump and his allies have filed a motion in Fulton County for a more thorough review of their claim that the speech involved in the election interference case is protected under the First Amendment. Steve Sadow, Trump's lead attorney in Georgia, articulated the group's stance, stating, "President Trump and the other unjustly accused defendants have jointly filed a motion requesting the Court to grant a certificate of immediate review of its Order denying their pretrial First Amendment challenges. The motion powerfully expresses that the Indictment wrongfully criminalizes core political speech and expressive conduct protected by the First Amendment. There is no democracy without robust and uninhibited freedom of expression. For these reasons among others, the Court’s Order is ripe for pretrial appellate review."

Last week, Fulton County Superior Court Judge Scott McAfee turned down the argument that Trump's assertions of election fraud were safeguarded political speech. "The defense has not presented, nor is the Court able to find, any authority that the speech and conduct alleged is protected political speech," McAfee concluded, elaborating that, the alleged false statements could be perceived as an attempt to deceive government agencies, and were made knowingly and willfully. In contrast, the former president's legal representatives hold that restricting their client's expression is a direct threat to democracy, with the free and uninhibited exchange of ideas serving as its very cornerstone, as reported by FOX 5 Atlanta.

Simultaneous to contesting the free speech issue, Trump's attorneys have filed for an appeal of a separate ruling which permits Fulton County District Attorney Fani Willis to maintain her role in the case. Despite defense efforts to dismiss her based on her relationship with special prosecutor Nathan Wade, and controversial comments made in January, McAfee allowed for the decision to undergo appellate review. In defense of Willis’ eligibility, her office responded firmly, underscoring that the trial court had undertaken comprehensive consideration of her past statements and concluded that no violation warranted her disqualification.

Trump's ongoing battle with the legal system has now prompted his team to approach the Georgia Court of Appeals. In unison, the attorneys for all co-defendants who have yet to settle, have signed off on this latest appeal, as detailed by Atlanta News First. In a statement provided to CBS News, Willis' office has maintained that mere dissatisfaction with factual findings does not justify an appeal or the reversal of a trial court's order.
