A man implicated in a fatal shooting on Beale Street last month is back in custody, facing upgraded charges of first-degree murder. WREG reports that Quavarre Rogers, 27, was originally charged with second-degree murder following the incident that led to the death of 52-year-old Damein Hawkins outside Jerry Lee Lewis' Café on March 17.

Rogers' legal situation took a turn when he was released from jail on April 10 after the initial charges were dismissed due to "lack of prosecution,", according to Local Memphis. However, the District Attorney's Office swiftly responded by presenting the case to a grand jury the following day, resulting in an indictment. A warrant was subsequently issued for Rogers's re-arrest.

This series of events culminated in Rogers being taken into custody again on April 16 in Olive Branch, Mississippi, as disclosed by the Shelby County District Attorney's Office. Alongside the first-degree murder charge, Rogers is also accused of possession of a prohibited weapon, an offense identified during the investigation of the shooting, as per FOX13 Memphis.

"Our office has presented the case before a grand jury and anticipate that the facts of the case will return an indictment," the Shelby County D.A.'s office told Local Memphis in a statement. "It is crucial to remember that a case's dismissal in general sessions does not necessarily indicate that it is concluded." Rogers, who was extradited to Shelby County, is being held on a $1 million bond.

On the night of the shooting, a dispute erupted into violence. Memphis Police reported that at approximately 2 a.m., officers heard a gunshot amidst a chaotic scene. They discovered a critically injured man, later recognized as Hawkins, who ultimately succumbed to his injuries. Authorities claim they saw Rogers armed and near the victim, and after a pursuit, they arrested him. Rogers was allegedly found in possession of a modified firearm, converted into a machine gun, which was supported by video evidence of the shooting, according to an affidavit provided by FOX13 Memphis.
