
A former Wellesley psychiatrist, Dr. Gustavo Kinrys, has been sentenced to nearly 100 months for a multimillion-dollar insurance fraud operation. Dr. Gustavo Kinrys, a psychiatrist who once practiced at Advanced TMS Associates in Natick, Massachusetts, billed for non-existent mental health treatments to the tune of over $19 million, diverting critical care funds. His extravagant purchases, financed through this scheme, included luxury homes and over $600,000 in fine jewelry, according to the U.S. Attorney's Office.
Yesterday, U.S. District Court Judge Denise J. Casper sentenced Kinrys following his October 2023 conviction on multiple fraud and false statement charges. During the trial, evidence revealed that Kinrys billed for more than 8,000 treatments never provided, although Kinrys claimed they were, as reported by the U.S. Attorney's Office.
In his scheme, Dr. Kinrys billed for thousands of Transcranial Magnetic Stimulation (TMS) therapy sessions and psychotherapy appointments—including on days he was out of the country. "Dr. Kinrys undermined the trust that our healthcare system relies upon," said Acting United States Attorney Joshua S. Levy. "His attempts to obstruct justice in order to conceal his scheme," added Levy, pointing out the calculated efforts to cover up the fraudulent behavior, which compromised the integrity of the healthcare services, according to the U.S. Attorney's Office. To maintain the facade, fictitious patient records were fabricated to mislead investigators.
After Kinrys' elaborate operation came crashing down, he faced the consequences in court with a sentence intended to reflect the gravity of his offenses. "This 99-month sentence reflects the seriousness of Dr. Kinrys’ crimes – his violation of the public’s trust in his position as a physician and his theft from the American taxpayers," Roberto Coviello, Special Agent in Charge of the U.S. Department of Health and Human Services, Office of Inspector General, said, as stated by the U.S Attorney's Office. Kinrys was convicted despite his efforts to subvert the legal process.
The Federal Bureau of Investigation also underscored the betrayal inherent in Kinrys' actions. "Gustavo Kinrys lied to Medicare and private insurers, billing them for over $19 million worth of mental health treatments he never provided and then obstructed our investigation in an attempt to cover up his crimes," said Jodi Cohen, Special Agent in Charge of the FBI, Boston Division, as reported by the U.S. Attorney's Office. Lastly, the sentence delivers a strong message against health care fraud in Massachusetts, stated Anthony M. DiPaolo, Executive Director of the Massachusetts Insurance Fraud Bureau.
