
In Cobb County, court officials have announced a month-long extension of the current Judicial Emergency affecting the Superior Court, as efforts continue to address a significant document backlog resulting from software issues. FOX 5 Atlanta reported that the emergency, which began on August 7, 2024, due to a troubled transition to a new software system in June, has led to a myriad of documentation problems, impacting the delivery of legal services and access to court proceedings.
According to Atlanta News First, the initial end date of September 6, 2024, has been pushed to October 6, 2024, by Chief Judge A. Gregory Poole. Court documents are still suffering from being "unindexed," with the backlog reaching as far back as November 2023. The continuous extension will provide more time to index all documents in the new system, an essential step to restoring court functions.
Apart from the software problems, staffing shortages exacerbate the court's troubles. The office is operating with only 61 staff members, a decline of 43 from its original capacity. "Court staff could not find documents. Attorneys and litigants could not find documents for their cases. Law enforcement couldn't find protective orders and bench warrants. In many cases, notices to come to court have been inaccurate, or not gone out at all," Superior Court Administrator Christopher Hansard told FOX 5 Atlanta.
Officials express concerns over the integrity of the judicial process amidst these operational deficiencies. In a release, the court stated, "At present, there are still instances where documents are unavailable to the public within the old CRIS system and simultaneously unavailable to court staff within the new Icon system." The Chief Judge persists in his belief that these ongoing issues "raise serious due process and other constitutional concerns." Despite the extension, judges have been attempting to work with individuals affected by the backlog to ensure justice is served as effectively as possible under the circumstances, as reported by FOX 5 Atlanta.
