"A college campus should be a place where the exploration and sharing of ideas and opinions is able to flourish, but conviction in your ideals is not an excuse for violations of the law," Nessel stated, as per FOX 2 Detroit. She emphasized the distinction between protected speech and unlawful activities. This sentiment was echoed in the charges brought forward, which the Attorney General's office clarified were not based on the content or subject of protected speech.

The encampment, which began in April and eventually expanded to include approximately 60 tents, was dismantled by police after failing to comply with the fire marshal's safety recommendations. As stated by WWJ Newsradio, the primary fire hydrant near the library had been vandalized rendering it inoperable, adding to the perceived urgency of the situation. The morning of the confrontation saw police issuing a dispersal order and eventually taking action when some demonstrators resisted evacuating the site.
