Arriving at the scene, officers were greeted by the scent of alcohol on Misri's breath, and his behavior was consistent with someone who had been drinking. It was reported that employees of the business had seen Misri driving shortly before the disturbance started, and empty alcohol bottles were found later in his backpack.

Further investigation by the officers led to the discovery of a fraudulent driver's license in Misri's wallet, alongside his valid California identification. The Colma Police Department's report detailed that a second, horizontal driver's license proved fake upon closer inspection, while Misri's actual vertical driver's license indicated his legal age.

Misri agreed to a preliminary alcohol screening test, and the results registered almost four times the legal limit. Having failed the test, Misri was detained and officially charged. "Dhillon Misri, a San Bruno resident, was arrested for possessing a fraudulent drivers license and driving under the influence of alcohol", stated the Colma Police Department. He was subsequently booked into the San Mateo County Jail.
