According to the San José Police Department, the incident was reported to the authorities after the victim, an adult female who chose to remain anonymous, bravely drove herself to a local hospital at around 2:55 AM. The victim reported that she had been assaulted in her vehicle by an unknown assailant. The SJPD's Sexual Assault Investigations Unit (SAIU) quickly initiated an investigation, meticulously gathering evidence that eventually led to Cortez's identification as a suspect. San Bernardino Police carried out his arrest on August 6, and he was subsequently transferred to San José, where he was booked at the Santa Clara County Main Jail on charges of sexual assault.
