Middlesex District Attorney Marian Ryan informed the public that 23-year-old Rafael Garcia-Rey has been convicted of the murder of Odogwu Ganobi and sentenced to life imprisonment. During the incident in question, which unfolded on November 15, 2022, in Lowell, Garcia-Rey was with his girlfriend, Anastasia Svay, when they were approached by Ganobi in a traffic altercation that quickly escalated. Garcia-Rey, following a verbal confrontation, fatally shot Ganobi and, subsequently, along with Svay, fled to New Hampshire, according to the Middlesex District Attorney's Office.
Further compounding this case was the actions of Svay, who was expected to stand as a prosecution witness but instead agreed to abscond in exchange for money. She was later charged for accepting a bribe to affect her testimony and her bail was set at $2,500 following her arraignment in Lowell District Court on September 12. "The defendant in this case needlessly escalated a minor traffic situation and then used an illegally possessed gun to shoot Ganobi," DA Ryan stated. "This is another example of the disturbing trend of senseless violence ending in a tragic loss of life," a statement obtained by Middlesex District Attorney's Office.
Garcia-Rey's sentencing also includes concurrent terms for carrying a firearm without a license and carrying a loaded firearm, adding four to five years in state prison and two and a half years in the House of Correction, respectively. These sentences will be served at the same time as the life sentence for the murder.
Despite Svay’s absence at the trial, the proceedings carried on and resulted in Garcia-Rey’s conviction. DA Ryan highlighted the insidiousness of Garcia-Rey's attempt to evade justice by colluding with a witness, undermining the integrity of the legal process. "Our justice system depends upon the integrity of the process," Ryan emphasized, signaling a commitment to uphold the law and ensure accountability. This case was a joint effort, investigated by the Middlesex District Attorney’s Office, the Lowell Police Department, Massachusetts State Police Detectives assigned to the Middlesex District Attorney’s Office, and the Middlesex Sheriff’s Office.
