The Arizona Department of Health Services (ADHS) has issued a provisional license to Avista as of Tuesday, securing a lifeline for residents, who now have the option to stay put and experience what is hoped to be improved care under the new ownership. According to a news release by ADHS, the transition is being managed with immediate effect, aiming for a seamless handover that prioritizes resident wellbeing.
Avista Senior Living's takeover follows a year of contention and legal tussles for Avanti, culminating in a Superior Court dismissing a motion to stay the revocation of Avanti’s license earlier this month, as detailed in the ADHS timeline of events.
The health department's action is a concluding chapter to a drawn-out series of regulatory failures by Avanti. Citing a persistent unresolved pattern of negligent practices, ADHS had warned Avanti more than a year prior to their license being revoked. This decision was, however, upheld by two different courts, with an Administrative Law Judge condemning the establishment’s disregard for regulations.
