
A Florissant man was sentenced to 15 years in prison after accepting an Alford plea for a wrong-way crash that claimed the life of a 7-year-old child and caused injury to two others. Dioavian Cook, 25, entered the plea which is a form of a guilty plea where the defendant does not admit to the act and asserts innocence. Despite this, they acknowledge that the evidence presented by the prosecution would likely result in a guilty verdict if brought to trial. According to FOX 2 Now, Cook was sentenced yesterday for the 2023 crash, which occurred on Interstate 70 in St. Charles County.
The collision happened on August 12, 2023, when Cook drove the wrong way at 100 miles per hour on the Interstate, striking another vehicle. The child, from the Kansas City area, was killed in the impact, and the 24-year-old driver suffered injuries. As reported by KSDK, two hours following the incident, Cook’s blood alcohol content was recorded at approximately .20%, which is more than twice the legal limit in Missouri.
St. Charles County Circuit Court Judge Michael Fagras sentenced Cook to the maximum recommended sentence of 15 years during proceedings yesterday. A release from St. Charles County Prosecuting Attorney Joseph McCulloch detailed the events of the crash and highlighted Cook’s recklessness on the road. The other two adults in the car at the time of the accident, both aged 42, were also injured but managed to survive.
Cook’s arrest was made by troopers from the Missouri State Highway Patrol, and he himself sustained serious injuries that required hospitalization. According to a statement obtained by First Alert 4, the prosecuting attorney’s news release also noted Cook's significant intoxication at the time of the medical blood draw post-crash. The use of the Alford plea allows defendants like Cook to maintain a claim of innocence while still accepting the burden of a conviction.
