
A man charged in connection with the shooting that resulted in the death of another man at an Edgewater Tesla charging station was acquitted by a jury on Wednesday. Jeremy Alan Smith, 40, faced accusations of fatally shooting 33-year-old Adam Fresquez on May 3, 2023. KDVR reported the jury's finding of Smith's innocence.
The incident unfolded when both parties arrived at the supercharger station on the 5500 block of West 20th Avenue near the Edgewater Public Market. According to The Denver Gazette, Fresquez got out of his car ostensibly holding a weapon, and approached Smith’s Tesla. In response to what he perceived as an imminent threat, Smith used pepper spray on Fresquez, who then proceeded to move to the back of the vehicle. Smith claimed he then fired his handgun over his shoulder, striking Fresquez twice in the back.
The court heard that a 9mm bullet was found on the ground and testimonies from witnesses supported the defense's narrative that Fresquez was armed and had approached Smith’s vehicle aggressively. Smith's act of self-defense was corroborated, as he took the witness stand, asserting that Fresquez had a 9mm handgun drawn and even prepared it to fire. After the shooting, Smith quickly reported the incident himself by dialing 911 and explaining, that he shot a man in self-defense.
A subsequent autopsy confirmed that Fresquez suffered two gunshot wounds to the back. Associated toxicology reports also detected the presence of cocaine and fentanyl in his system at the time of his demise. According to 9News, authorities found a gun inside Fresquez's clothing at the scene. Police later retrieved another gun inside Smith's red Tesla, and a third weapon wrapped in a sweatshirt within Fresquez’s vehicle, all detailed in the arrest affidavit.
