The suspects took flight, but the driver, while trying to escape was bitten by the K9, fell from a fence, and was subsequently handcuffed. According to the plea agreement, it was then that Gaither "lifted the driver from the ground to escort him to a police vehicle, he struck the driver twice in the face without justification and without a legitimate purpose," as per the U.S. Attorney's Office.

Charged with deprivation of rights under color of law, Gaither faces a sentence that could yield up to 10 years in prison, a fine reaching $250,000, or potentially both. His hearing is set for May 2. The consequences of his guilty plea reflect a move toward accountability in law enforcement practices, a subject of intense scrutiny in recent years.

The FBI took charge of the investigation while Assistant U.S. Attorney Christine Krug is handling the prosecution.
