
The parents of 2-year-old Jaylin Branch Jr. filed a lawsuit against Grandma Jones Daycare in Calumet City, following the boy's tragic death. According to a suit filed in Cook County Circuit Court and reported by FOX 32 Chicago, negligence and improper supervision are being alleged after the young boy experienced a fatal medical event at the daycare on February 20th.
An established medical action plan existed for Jaylin, owing to his epilepsy diagnosis since he was almost five months old. Nevertheless, the lawsuit accuses the daycare staff of failing to periodically check on him during his nap time and asserts inadequate training in managing medical emergencies. In an unsettling development, daycare personnel did not adhere to the safety measures that should have been protective armor against such an incident. The family is seeking damages that exceed $50,000 for the wrongful death and conscious pain and suffering of their son.
On that fateful day, as described in court documents and detailed by ABC7 Chicago, Jaylin was laid down for his nap post-lunch around noon. Roughly an hour later, daycare staff found him unresponsive with blue lips. The police report confirms the response of officers to the daycare at approximately 1 p.m. that day.
Jaylin's mother had worked with the daycare to construct a vigilant action plan on the off chance he suffered a seizure. At the scene, however, she found that the planned blueprint of response was sadly not enacted. The family, through their legal representation, has pushed for the state to subject the daycare to a thorough investigation. The boy's untimely passing is being legally challenged by attorneys Cierra Norris and Evan Finneke of the C. Norris Law Group.
