
The New York Attorney General's Office, headed by Letitia James, has released a report detailing the findings of its investigation into the police-related death of Courtney Gordon. The Office of Special Investigation (OSI) concluded, following an exhaustive review which included body camera footage and interviews with first responders from the New York City Fire Department, that the officer's actions in the fatal shooting of Mr. Gordon could not be legally challenged in court due to the justifications provided by New York law, as per the Attorney General's website.
Details of the December 3, 2023, incident emerged when NYPD officers answered a call indicating an "assault in progress" on Beach 22nd Street in Queens. Arriving at 5:08 a.m., they saw Mr. Gordon leave a house with luggage. As they attempted to approach him, Gordon presented a knife, resulting in one officer being stabbed in the neck while the other sustained a slash to the forehead. In reaction to this life-threatening assault, the injured officer discharged their weapon, fatally wounding Mr. Gordon. Despite the tragic outcome, officials stated they would not be able to prosecute as the evidence pointed to self-defense under the said law.
According to the official report, "Under New York’s justification law, a police officer may use deadly physical force when the officer reasonably believes it to be necessary to defend against the use of deadly physical force by another." In Mr. Gordon's case, the officers were responding to credible threats of violence and had reason to suspect he carried a weapon capable of causing grave harm. Given these circumstances, OSI asserted that the prosecution would not be able to "disprove beyond a reasonable doubt at trial that the officer’s use of deadly physical force against Mr. Gordon was justified."
The OSI findings have sparked no immediate plans for criminal charges against the officers involved. Despite various pressures and the complexities often inherent in such cases, the application of law in the decision was explained as clear-cut due to the immediate danger faced by the officers.
